The Director of Education has assured the Bombay High Court at Goa that he would withdraw the order passed taking over the management of St Thomas Boys High School in Aldona and pass a fresh reasoned order.
The statement was made before the court based on a petition filed by the Fransalian Education Society, who had challenged the order passed by the Directorate of Education, stating that they were taking over the management of the school owing to an internal dispute between the management and the headmaster, and appointing an administrator to run the school.
High Court single bench of Justice M S Karnik noted that since the impugned order is not a reasoned order, the same is vulnerable which promoted the Advocate General who submitted that the director of education will withdraw the order and pass a reasoned order in accordance with law.
“Considering the nature of the allegations in the complaint, let a reasoned order be passed by the Director, in accordance with law within a period of four weeks from today,” the High Court ruled.
The Directorate of Education claimed to have received several complaints from parents and others regarding the mismanagement of the affairs of the school following which a show-cause notice was issued to the management of the school.
However, the replies of the school management were found to be unsatisfactory in nature, the Director said in his order. According to the Directorate of Education, the school would be run via the administrator for a period of three years.
“After going through the reply filed by the headmaster of the school, it has been found that the school management committee of St Thomas Boys High School, Aldona, has contravened the provisions of the Goa School Education Act, 1984, and Rules. It neglected to perform its duty/ obligation imposed on it. It mismanaged the affairs of the school and managed the affairs of the school in a manner prejudicial to the public interest,” the order passed by the Directorate of Education ruled.
