High Court orders probe into illegal constructions in Socorro

Petitioner alleges illegal structures under 20-Point Programme

The High court of Bombay at Goa has directed Dy collector, Bardez to conduct an enquiry into the structures that have been constructed in 20 point programme area at Succor and submit his detailed report within the period of six months.

Nilesh Gajanan Chari had filed a Writ Petition in the High court of Bombay at Goa mentioning about the inaction on the part of State Authorities and Village Panchayat of succor in not taking the action about the illegal structures erected under the 20-point guidelines. Chari has mentioned in his writ petition that the said houses have been constructed in excess of the permissible limits and that they are sold /rented out for commercial purposes which is not a permissible use of the premises. Since no positive action was taken by state authorities Chari approached the court to take action against alleged irregularities in implementation of the 20 point programme in Succor village. He has also prayed for the cancellation of the allotment of the plots where such constructions have been carried out and cancelations of the trade licenses permitting the commercial activity to be run in these structures.

Responding to the aforesaid petition the Dy Collector/SDM Bardez has filed an affidavit wherein it has been categorically stated that 20 point programme, contemplated land admeasuring 100 sq.mts to be provided to the eligible persons for construction of the houses and also in case that allotee has constructed his house beyond 100 sq.mts. then the same may be regularised up to the extent of 50 sq.mts. on payment of fines. The scheme also contemplated that if any person other than legal occupant to whom the land has been allotted is found to be occupying the land then he shall be summarily evicted and the land would be resumed by the state government. A categorical statement has been made in the affidavit that the 31 allotments that were granted originally under 20 point programme scheme a total of 67 structures exists on survey no.12/1 of village succor and 9 plots are occupied by the families of the originally allottes. However the remaining plots and structures do not align with the records of the allotment raising a question about them being in an unauthorised occupation of said premises.

In views of the aforesaid the High court of Bombay at Goa has directed the Deputy Collector of Bardez-Goa, to act as an officer for ascertaining the implementation of the 20 point programme in Socorro Bardez, who shall complete his enquiry and forward his report to the Collector, North Goa, within a period of six months, followed by an appropriate action by the Government against the erring persons.
