The Mapusa Municipal Council (MMC) has directed the owner of a city-market to demolish the stalls and sheds constructed at the periphery of the Mapusa town within 30 days failing which the council would demolish the same and recover the cost from him.
At least 40 stalls and sheds including a restaurant, ice cream parlour and other business enterprise have been constructed in the city-market complex on comunidade land near the Carvalho Petrol Pump in the jurisdiction of Mapusa municipality.
In a final notice issued to the city-market owner Atmaram Gadekar, the engineering department said a site inspection of the property carried out by the municipality officials have ascertained that 40 stalls and sheds with GI tubes and pipes with galvalium sheet roofing and cement board sheet walls have been constructed illegally in chalta no 5/1 of PT Sheet No 162 in Mapusa.
The notice also states that the owner failed to respond to a show cause notice issued under Section 184 (8) of the Goa Municipalities Act, 1968 calling for demolition of the illegal construction.
It also said that the owner was unable to submit any documents in support of the legality of the structure during the course of personal hearings.
The order signed by then Chief Officer Amitesh Shirvoikar on September 27, said the owner failed to obtain any prior permission of the council for the erection of the stalls/sheds and therefore they were unauthorized and illegal and against the provisions of the Goa Municipalities Act.
Incidentally, two years ago the then chief officer had issued a similar order directing the owner to stop all business activities in the areas and further the civic staff was ordered to seal the premises and also seize the materials.
The owner later managed to get a stay on the order from the Director of Municipal Administration.
Recently, the Administrator of Comunidades, North also issued a show cause notice to the city-market owner asking why action should not be initiated against the alleged illegal construction.
The Administrator of Comunidades, North, Shivprasad Naik has issued a notice to the owner for carrying out the alleged illegal construction in the property belonging to Mapusa comunidade.
