MPDA cites 4 complaints, issues show cause notice to Bhutani

In a major development, the Mormugao Planning and Development Authority (MPDA) on Thursday issued show cause notice to the controversial project by M/s Parmesh Constructions Company Limited alias Bhutani Infra at Sancoale based on the complaints filed by various individuals. 

The MPDA Member Secretary in the show cause notice issued has sought reply within seven days as why the Development Permissions granted to the project on February 2, 2024 should not be revoked, failing which action as deemed fit would be initiated. 

The planning body has citied four complaints received against the project pointing out to various illegalities and irregularities in seeking permissions and land conversions. 

Earlier in the day, TCP Minister Vishwajit Rane had directed MPDA to verify and have ground check of all the representations received against the project and if found against law to issue show cause notice. 

MPDA pointed out that from the drawings submitted at the time of grant of Development Permission under section 44, it is observed that the building project and the accessibility shown to the buildings within the plot shall require cutting of hilly land ie. land having gradient more than 1:10 as defined in the TCP Act  and the same requires prior permission of the Chief Town Planner (Landuse), which the project proponent failed to obtain, thereby violating Condition of the Development Permission. 

"It is also seen from the office records that the width of access shown to the property is only 7.00 mts and whereas the width actual required for the development proposed is 10.00 mts thus the width of the access as shown to the property is not in compliance with the Goa Land Development and Building Construction Regulations, 2010 to permit the development as proposed," MPDA said. 

It also said that M/s Bhutani Infra has utilized FAR to the extent of 200% for the property admeasuring 35,050 sq meters, which the complainants claims that the project proponent is not entitled to.

"It may be noted that besides the issues referred above, there are several other issues mentioned in the complaint, such as Private Forest, etc," MPDA said. 

"Hence you are hereby directed to show cause immediately; within 7 days from the receipts of this notice as to why action, namely revocation of the Development Permission issued vide MPDA/7-P-165/2023-24/1254 dated 02/02/2024 shall not be initiated," it said. 

"Please note that, if no reply is received within 7 (Seven) days from the receipt of this notice, this Authority shall proceed to take further necessary action as deemed fit," it added. 

The complainants have alleged that the entire project is illegal and it has no NOC from environment and forest department. It also said that the proposed project site was identified as Private Forest by Araujo Committee and the same was illegally converted into Class I. 

They also said that the project will lead to massive ecological destruction along with flora and fauna apart from severe problems of water, electricity and sewage to villagers.
