RERA orders Rs 47L refund over delay in handing over studio apartment

The Goa Real Estate Regulatory Authority (Goa RERA) has directed a developer to refund an amount of Rs 47.40 lakhs to a complainant within 60 days over the delay in handing possession of a studio apartment.  

The developer is further directed to pay interest at 11.10% per annum for the delay in delivering possession of the apartment to the complainant from the dates of such payments until the date of actual payment of the amount paid by the complainant.  

In this case, the complainant had approached Goa RERA after the real estate firm delayed giving possession of the studio apartment, despite having made a payment of Rs 47.40 lakh by taking out a loan from a bank. However, no possession of the studio was handed over to the complainant.  

Goa RERA member Vincent D’Silva further directed the real estate developer to pay Rs one lakh within 60 days of the order. Failing this, it will carry interest in terms of Rule 18 of The Goa Real Estate (Regulation and Development) (Registration of Real Estate Projects, Registration of Real Estate Agents, Rates of Interest, and Disclosures on Website) Rules, 2017, until payment.  

The developer has also been directed to pay Rs two lakh as a penalty under Section 61 of the Act for the violation of Section 11(4)(a) and (f), read with Section 18 of the Act. The amount must be deposited before the authority within 60 days, failing which the RERA Member has threatened to initiate necessary proceedings against the developer.
