PANAJI: The Margao District and Sessions Court has granted anticipatory bail to author and businessman Datta Damodar Naik, who faces charges of hurting religious sentiments. The verdict pronounced this morning comes after a marathon hearing held since mid-last week. 

On Wednesday, January 8, Naik filed an anticipatory bail application before the Margao Sessions Court after being booked by the Canacona Police for allegedly making remarks that hurt religious sentiments during an interview on a local TV channel. The FIR was filed under Section 299 of BNS 2023, following a complaint by Satish Bhat, a senior member of the Hindu Sanghatna.

The court heard the arguments on Thursday,January 9, where the Canacona Police vehemently opposed the bail plea, stating that Naik’s presence was essential for the investigation. They argued that releasing him on bail could result in witness intimidation and further disturbances.

Naik's legal team, led by senior advocate Cleofato Almeida Coutinho countered, asserting that no substantial offense was made out against Naik. He argued that at worst, Naik’s remarks could be seen as defamation, emphasizing that Naik had the right to express his opinions.

Naik expressed regret over his choice of words, particularly the term “loot,” clarifying that he meant “extract money.” He assured the court of his willingness to cooperate with the police.

The court, on Friday, January 10, further reserved its order on the anticipatory bail plea for Monday, which was pronounced in his favour.
