The Division Bench of Justice Valmiki Menezes and Justice Hiten Venegavkar said the SP should guide the Investigating Officer, the Sub-Divisional Police Officer (SDPO) and the investigating team to ensure a proper probe.
During the hearing, the Bench noted that no charge relating to attempt to murder had been invoked in the FIR so far. The Judges asked the police to study the injury certificate of the advocate and, if warranted by the evidence, invoke the appropriate provision relating to attempt to murder under section 109 BNS.
“The SP should guide the investigating team in taking an appropriate decision on the issue,” the Bench said as it also sought compliance on issues relating to Coastal Regulation Zone (CRZ) aspects connected with the matter from the concerned authorities. The case has been posted for further hearing on Tuesday at 2.30 pm.
The proceedings arise from the alleged assault on High Court advocate Ankur Kumar, 32, and his 75-year-old client, Anil Naik, at Tembwada, Morjim, on Friday, reportedly over a demolition order in a contempt petition filed by Naik.

In a twist to the case pertaining to the assault on advocate Ankur Kumar at Temwada-Morjim, Dilip Morje, one of the accused, has filed a counter complaint at the Mandrem police station, accusing the advocate of allegedly attempting to kill his daughter by running her over with the vehicle, as well as issuing death threats.
The woman stated that she was walking home when the advocate allegedly drove his vehicle towards her. “Had someone not pulled me aside, I would have been run over by the vehicle. The mental trauma of that incident still lingers," she claimed.
